What Are Argument Guides?

Argument guides are a new category of law book that includes a compendium of arguments directed to specific legal issues which were effective in past cases. Unlike traditional legal publications such as case books and practice guides—which are well suited for providing the current state of a particular area of law—our argument guides are designed to be a pragmatic resource that can remove decades from the time needed for attorneys to learn the most effective arguments and strategies for their practice areas.

A legal publisher and pioneer of new argument guides for law practice, our first set of offerings—Trademark Argument Guides for Likelihood of Confusion and Mere Descriptiveness—is based on the research of more than 25,000 cases. Tested against statistical measures, our guides take decades off the time generally needed for attorneys to learn these winning arguments and strategies. 

Founded in 2019, the idea for the guides dates back to 2013 when founder Herbert T. Patty, Esq. was working as a patent attorney.

As more and more clients began requesting trademark services, Mr. Patty became interested in discovering best practices, notably, the most unique arguments and strategies employed during ex parte prosecution proceedings at the USPTO. By answering the questions “Are legal arguments discrete elements that can be identified in various trademark cases?” “Which legal arguments have been used singularly, or in combination, to successfully overcome specific trademark refusals?” “Is it possible to perform a statistical analysis for legal arguments present in a large corpus of law briefs?” a new category of legal books was born.
